Terms of Service

These Terms of Service ("Terms") govern your use of Togimo (the "Game"), a mini game published by Shenyang Qingshaguo Network Technology Co., Ltd ("we", "us") and distributed on the TikTok platform. By playing the Game, you agree to these Terms. If you do not agree, please do not play.

1. Eligibility

You must meet TikTok's own minimum age requirement for your region in order to access the Game. If you are a minor under the law of your jurisdiction, you may play only with the consent of a parent or legal guardian, who accepts these Terms on your behalf.

2. Licence to Play

We grant you a personal, non-exclusive, non-transferable, revocable licence to play the Game for your own private entertainment. You may not copy, modify, decompile, reverse-engineer, or create derivative works from the Game, nor extract its assets, code, or level data, except to the extent that applicable law expressly permits despite this restriction.

3. Acceptable Use

When playing the Game, you agree not to:

• Use cheats, automation tools, modified clients, or exploits to gain an unfair advantage or manipulate scores
• Interfere with the Game's servers, network, or security measures, or attempt unauthorised access to any part of the service
• Use the Game for any unlawful purpose, or in breach of the TikTok Community Guidelines
• Impersonate another person or misrepresent your affiliation with any person or entity
• Sell, rent, or transfer access to the Game or to any account used to play it

4. Advertising

The Game is provided free of charge and is supported by advertising delivered through TikTok's in-app advertising service. Some features may require you to watch an advertisement in exchange for an in-game reward. Advertisements are served by TikTok, not by us, and we do not control which specific advertisements you are shown. Blocking, spoofing, or automating advertisement playback is a breach of Section 3.

5. Virtual Items and Paid Content

The current version of the Game contains no purchases and no paid content. Should we introduce virtual items, currency, or paid features in a future version, the following will apply:

• Virtual items are licensed to you for use within the Game only. You do not own them, and they carry no monetary value outside the Game.
• Virtual items cannot be exchanged for cash or transferred to another player or platform.
• Purchases are processed by TikTok under its own payment terms, and refunds are governed by TikTok's refund policy and by any non-waivable rights you have under applicable consumer law.
• Unused virtual items are forfeited if your access is terminated under Section 8, except where applicable law requires otherwise.

We will publish updated Terms before any paid content becomes available.

6. Game Progress and Availability

We aim to keep your progress saved, but we do not guarantee that progress will always be preserved. Progress may be lost through technical faults, platform changes, or account changes on TikTok's side. The Game is provided on an "as available" basis, and we may suspend it for maintenance, modify or remove features, or discontinue it entirely, with reasonable notice where practicable.

7. Intellectual Property

The Game, including its code, artwork, audio, level design, and name, is owned by us or licensed to us, and is protected by copyright and other intellectual property laws. These Terms grant you no rights in our trademarks or branding. Feedback you send us may be used without obligation or compensation, and sending feedback does not give you any rights in the Game.

8. Suspension and Termination

We may suspend or terminate your access to the Game if you breach these Terms, if we are required to do so by law or by TikTok, or if continued access would create a security or legal risk. You may stop playing at any time. Sections 7, 9, 10, and 11 survive termination.

9. Disclaimers

The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms excludes or limits any right you have that cannot lawfully be excluded or limited, including rights under mandatory consumer protection law.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, progress, or goodwill, arising out of or relating to your use of the Game. Where liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the amount you paid us for the Game in the twelve months preceding the claim, or (b) USD 50.

This section does not limit liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law.

11. Governing Law and Disputes

If you are resident in Japan, these Terms are governed by the laws of Japan, and you and we submit to the Tokyo District Court as the court of first instance.

If you are resident anywhere else, these Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles, and disputes shall be submitted to the courts of Singapore.

Nothing in this section deprives you of the protection of the mandatory consumer-protection rules of the country where you live, or of any right you have under those rules to bring proceedings before the courts of that country.

12. Relationship with TikTok

The Game runs on TikTok, and your use of TikTok itself is governed by TikTok's own terms and policies. TikTok is not a party to these Terms and is not responsible for the Game. Where these Terms conflict with TikTok's platform rules as they apply to mini games, TikTok's rules prevail.

13. Changes to These Terms

We may update these Terms as the Game develops. Material changes will be announced in the Game before they take effect. Continuing to play after the changes take effect means you accept the updated Terms.

本服务条款(以下称"本条款")适用于您对 翻翻(以下称"本游戏")的使用。本游戏由 沈阳青沙果网络科技有限公司(以下称"我们")发行,在 TikTok 平台上提供。您游玩本游戏即表示同意本条款;若不同意,请勿游玩。

一、使用资格

您须满足 TikTok 针对您所在地区设定的最低年龄要求方可使用本游戏。若您依所在地法律属于未成年人,须在父母或法定监护人同意的前提下游玩,并由其代为接受本条款。

二、使用许可

我们授予您一项个人的、非独占的、不可转让的、可撤销的许可,允许您为个人娱乐目的游玩本游戏。您不得复制、修改、反编译、逆向工程本游戏或据其制作衍生作品,亦不得提取其素材、代码或关卡数据,但适用法律明确允许的情形除外。

三、行为规范

在游玩过程中,您同意不从事下列行为:

• 使用作弊程序、自动化工具、修改版客户端或漏洞获取不当优势或操纵分数
• 干扰本游戏的服务器、网络或安全机制,或试图未经授权访问服务的任何部分
• 将本游戏用于任何违法目的,或违反 TikTok 社区自律公约
• 冒充他人或虚假陈述您与任何个人或机构的关系
• 出售、出租或转让本游戏的使用权或用于游玩的账号

四、广告

本游戏免费提供,通过 TikTok 应用内广告服务获得收入。部分功能可能需要您观看广告以换取游戏内奖励。广告由 TikTok 投放而非由我们投放,我们不控制您所看到的具体广告内容。屏蔽、伪造或自动化广告播放的行为构成对第三条的违反。

五、虚拟物品与付费内容

本游戏当前版本不含任何内购或付费内容。若我们在后续版本中推出虚拟物品、虚拟货币或付费功能,将适用以下规则:

• 虚拟物品仅授权您在游戏内使用。您不拥有其所有权,其在游戏外不具有货币价值。
• 虚拟物品不可兑换现金,不可转让给其他玩家或其他平台。
• 付费交易由 TikTok 依其支付条款处理,退款事宜适用 TikTok 的退款政策以及您依适用消费者法律享有的不可放弃的权利。
• 若您的访问权限依第八条被终止,未使用的虚拟物品将失效,适用法律另有规定的除外。

在任何付费内容上线之前,我们将发布更新后的条款。

六、游戏进度与服务可用性

我们会尽力保存您的游戏进度,但不保证进度始终得以保留。进度可能因技术故障、平台变更或 TikTok 侧的账号变动而丢失。本游戏按"现有可用"状态提供,我们可能因维护而暂停服务、修改或移除功能,或完全终止运营;在可行的情况下,我们将提前作出合理通知。

七、知识产权

本游戏及其代码、美术、音频、关卡设计和名称归我们所有或由我们获得许可使用,受著作权及其他知识产权法律保护。本条款未授予您对我们商标或品牌标识的任何权利。您向我们提交的反馈,我们可无偿使用且不承担任何义务;提交反馈不使您获得对本游戏的任何权利。

八、暂停与终止

若您违反本条款、若法律或 TikTok 要求我们采取措施,或若继续提供服务将产生安全或法律风险,我们可暂停或终止您对本游戏的访问。您可随时停止游玩。第七条、第九条、第十条及第十一条在本条款终止后继续有效。

九、免责声明

本游戏按"现状"和"现有可用"状态提供。在法律允许的最大范围内,我们不作任何明示或默示的保证,包括对适销性、特定用途适用性及不侵权的默示保证。我们不保证本游戏不中断、无错误或不含有害成分。

本条款中的任何内容均不排除或限制依法不得排除或限制的权利,包括强制性消费者保护法律赋予您的权利。

十、责任限制

在法律允许的最大范围内,对于因使用本游戏引起或与之相关的间接、附带、特殊、后果性或惩罚性损害,以及数据、进度或商誉的损失,我们不承担责任。在责任不可排除的情形下,我们的累计责任总额以下列两者中的较高者为限:(a) 索赔发生前十二个月内您就本游戏向我们支付的金额,或 (b) 50 美元。

本条不限制因过失造成的死亡或人身伤害的责任、欺诈责任,以及依适用法律不得限制的其他责任。

十一、适用法律与争议解决

若您居住在日本,本条款适用日本法律,并以东京地方法院为第一审管辖法院。

若您居住在其他国家或地区,本条款适用新加坡法律,不适用其冲突法规则,争议应提交新加坡法院解决。

本节不剥夺您居住地强制性消费者保护规则给予您的保护,也不剥夺依该等规则您在居住地法院提起诉讼的权利。

十二、与 TikTok 的关系

本游戏运行于 TikTok 平台之上,您对 TikTok 本身的使用受 TikTok 自身条款和政策约束。TikTok 并非本条款的当事方,不对本游戏承担责任。本条款与 TikTok 适用于小游戏的平台规则冲突时,以 TikTok 的规则为准。

十三、条款变更

随着游戏的发展,我们可能更新本条款。重大变更将在生效前于游戏内公告。变更生效后继续游玩即表示您接受更新后的条款。
